To use IBTI Web Tools you must necessarily know our Terms of Use and our Privacy Policy and agree with them. We recommend that you read our terms very carefully, together with your parents or guardians if you are under 18, and, if you have any questions, be sure to contact us by email at igor.brandao@ibti.tech or via the “CONTACT” channel.

WHAT IS IBTI WEB TOOLS

IBTI WEB TOOLS is a platform that aims to provide an easy and reliable website performance and uptime monitoring solution, with highly customizable and fast status pages.

HOW TO USE IBTI WEB TOOLS

To use IBTI Web Tools, the USER will need to complete a simple registration: provide their full name, email and password. You also have the option of registering using a personal social media account (Facebook, Twitter, Google and others) that is available on the Platform. In this case, IBTI Web Tools will only receive public data from the USER's profile, on the social media used.

Once the account is created, and the USER accepts our Terms, they will be able to use the platform's resources according to the chosen plan.

At any time after registering on the Platform, the USER may provide additional data to improve the usp experience, such as including a photo to personalize their profile on IBTI Web Tools. The photo can be in jpg, jpeg or png format, with a maximum size of 2Mb. The insertion of photos of third parties or any image considered illegal is prohibited.

WHO CAN REGISTER FOR IBTI WEB TOOLS

Individuals and legal entities can register with IBTI Web Tools. USERS under the age of 18 undertake to be accompanied by their parents or guardians when registering for the Payment Method account and when using the credit card made available to them to purchase the Plans.

The USER will be solely responsible for their login and password and will be responsible for all acts carried out on IBTI Web Tools. It is the USER's duty to ensure the safety and confidentiality of their password. IBTI WEB TOOLS will not be responsible for any loss resulting from the misuse of the USER's password by third parties.

THE USER EXPRESSLY CONSENTS TO THE COLLECTION, PROCESSING AND PROVIDING TO THIRD PARTIES OF THEIR PERSONAL DATA AND ACCESS TO THE PLATFORM, AS DETAILED IN THE PRIVACY POLICY, WITHIN THE LIMITS OF THE GENERAL DATA PROTECTION LAW.

If the USER, their parents or guardians are not comfortable with the processing of data, under the terms of our Privacy Policy, we recommend that they do not register. If you have already done so, you may revoke your consent, in accordance with art.15, III of Law 13,709, by canceling your account.

The USER who performs any acts in violation of these Terms of Use may be punished with the suspension or cancellation of their account at IBTI Web Tools, without prejudice to the appropriate legal actions being taken.

ACCOUNT CANCELLATION

In accordance with art.7 of the Marco Civil da Internet, at any time, the USER may cancel their account, simply by going to the “Account Deletion” field or sending an email to igor.brandao@ibti.tech, with the title: Account Deletion - IBTI Web Tools, as stated in the Privacy Policy.

RESPONSIBILITIES

The USER undertakes to:

(i) provide only true, accurate, current and complete information at the time of registration, when taking the test or at any other time when using IBTI Web Tools;

(ii) ensure the security of your login and password;

(iii) not use the Platform without the supervision or authorization of parents or guardians in the case of minors under 18, especially when purchasing Plans;

(iv) not use the IBTI Web Tools or IBTI logo without express written authorization from IBTI;

(v) do not insert photos that contain obscene, offensive acts or that condone terrorism, violence and/or discriminatory acts against individuals, ethnic and religious groups, public figures and the like;

(vi) do not insert photos with company logos or images of other users; photos of children, people in swimwear, lingerie or nude, images that contain links or email addresses, or other contact data or in any illicit way;

(vii) not copy, modify, reproduce, distribute, download, store, transmit, sell, resell, reverse engineer or create derivative products from any content available on IBTI;

(viii) Do not violate or attempt to violate the security of IBTI Web Tools, or take advantage of any system inconsistency to gain an advantage for yourself or third parties, or cause harm to IBTI Web Tools and/or third parties, especially when accessing or attempting to access any IBTI Web Tools USER account, or when obtaining and disclosing the IBTI Web Tools USER password.

(ix) Do not pass on any material developed by IBTI to third parties without its express authorization.

IBTI WEB TOOLS is committed to:

(i) allow USER access to the Platform and its functionalities, upon complete registration;

(ii) allow USER access to Plan resources, after payment of the fee has been confirmed;

(iii) make efforts to maintain the continuity of the services offered by the platform. However, for technical reasons beyond the control of the platform, it may be unavailable for a period of time;

(iv) maintain a contact channel for any reports, questions or complaints from its users.

INTELLECTUAL PROPERTY

The information contained on the IBTI Web Tools website, as well as its brand, business name, domain name, programs, source codes, databases, networks and files are the property of IBTI and are protected by copyright rules, being absolutely prohibited the copying, distribution, use or publication, in whole or in part, of any material or part of the Application and all content available therein, without prior and express authorization from IBTI.

CHANGES TO THE TERMS OF USE

When there are changes to the IBTI Web Tools Terms of Use, the USER will be notified via email or by posting in a prominent area on the Platform.

APPLICABLE LAW

Brazilian law applies to these Terms solely and exclusively, in particular the Marco Civil da Internet (Law No. 12,965) and the General Data Protection Law (Law No. 13,709) so that any legal action, related to their interpretation or application, must be processed and judged by the Brazilian Judiciary.

In case of conflict of state or municipal laws, for the interpretation of any doubt or dispute, the legislation of the State of São Paulo must always prevail.

QUESTIONS AND REPORTS CHANNEL

If there are any doubts regarding this document, or if a violation of these Terms of Use or the IBTI Web Tools Privacy Policy is reported, the Administrator must be contacted by email at igor.brandao@ibti.tech, using it in the title of the message the phrase: “Terms of Use - IBTI Web Tools” or through the “CONTACT” channel.
